HC notice to Education Minister over plea by college body

The Nagpur Bench of the Bombay High Court has issued a notice to Maharashtra Education Minister Rajendra Darda on a petition filed by an Akola-based society regarding cancellation of permission to run their junior college.

A pision Bench comprising Justices Vasanti Naik and Prasanna Varale, while staying Darda's decision to cancel the college's permission, also issued notices to other respondents asking them to file their replies within three weeks.

The other respondents included Education Secretary, Principal Secretary (School Education), Director of Education, Deputy Director of Education, Education Officer of Amravati Zilla Parishad and Payoshni Shikshan Sanstha.

The petition was filed by Sanjay Deshmukh, President of Varhad Bahuuddeshiya Sanstha.

According to Anil Kilor, counsel for Deshmukh, the state had on July 23, 2008 granted permission to the society to run its Bhausaheb Deshmukh Arts, Commerce and Science Junior College at Ghungsi, Akola district.

After about two years, its rival — Payoshni Shikshan Sanstha filed a petition in the Nagpur Bench challenging the permission. The Bench on August 30 last year directed the Government to decide on the representation made by the petitioner's rival within three months.

Principal Secretary (School Education) passed an order on November 20, 2010 holding that permission granted to the junior college was proper and without any illegality.

The Payoshni Shikshan Sanstha filed an application with Darda on June 14. The Minister conducted a hearing on June 20 and passed an order cancelling the permission granted to the petitioner to run his junior college.

The petitioner moved the court seeking quashing of Darda's order. He also sought a probe as to why the permission to run the college was denied in spite of a "good track record" with regard to education.
