School restrained from reducing working hours

Madras High Court bench restrained the Secretary and Principal of a matriculation school from reducing regular schooltime by four hours for non-payment of excess amount (donation) to a welfare trust and withdraw the bus facility from whom fees had been already collected.

Justices P Jyothimani and M M Sundaresh, admitting a petition by Parents Association Secretary R Sowmya, also restrained Arogya Welfare Trust (under whose head donations were collected) from conducting any educational curricular and allied activities in Lakshmi Matriculation School.

They also ordered notice to the secretary and principal.

The Petitioner submitted that school authorities had given an undertaking they would not insist on parents paying any amount more than fees determined by the Private school fee determination committee.

However they collected excess fee in 2010-11, which was not adjusted in 2011-12(for fees). Now school authorities were insisting on additional amount to the trust and that the school hours would be reduced from full day to half a day for those who did not pay up. Besides they would also not be given 30 additional facilities.

The petitioner said though most activities were prescribed by ISCE board, facilities like lab, computer education were denied to students for non payment of excess amount. Parents were also not permitted to visit the school.

Though representation had been made to the education department officials to take legal action against the school, nothing had been done so far, she said.
