HC orders Jamia Varsity to admit student externed from campus

Terming the refusal of admission by Jamia Millia Islamia University to a Ph D student on the ground of his alleged involvement in an act of indiscipline as "draconian", the Delhi High Court has come down heavily on the University and directed the admission of the student.

"It is an absolutely draconian decision taken by the University to ban the entry of the petitioner in its campus where he has been a student for last so many years..." said Justice Kailash Gambhir and set aside the University's campus ban notice against Ashraf Kamal.

Directing the University to consider the registration of Kamal in Ph D programme for Dalit and Minority Studies if he fulfills other criteria, the court said it "would only like to observe that the teachers are revered as Gods in our culture and are responsible for shaping the lives of their students and the sanctity and the status of this position should be maintained".

Kamal, who was a student of the University since long and finished his Master's degree in 2008, had opted to do Ph D there but in October last year the University had served a notice banning his entry in the campus.

According to the University October 12, 2010, notice, Kamal was involved in an act of indiscipline twice in 2005 and 2006 and recently he was seen in the campus parking his car inside the campus at no parking area and it is feared that the presence of the petitioner in the campus may cause law and order problem and thus a campus ban was imposed on him.

"This court fails to perceive as to how parking of the car by the petitioner in no parking zone can result in taking a harsh decision by the University putting a complete ban on him to enter the campus and that too for an indefinite period.

"This court fails to fathom how the presence of the petitioner in the campus will result in creating law and order problem," the court said.
