The Madras High Court today stayed Medical Council of India's recent notification for holding national level entrance examinations for graduate and
post-graduate courses in Tamil Nadu.
When two petitions filed by the Tamil Nadu government challenging the MCI notifications came up for hearing, Justice P Jyotimani granted the stay on its implementation in so far as it related to Tamil Nadu and ordered notice to the Union
Government and MCI.
The notifications on "Regulations of Graduate Medical Education (Amendment)-2010 and Regulations of PG Medical Education (Amendment) 2010", which prescribed that single national eligibility–cum–entrance tests for admission within respective categories shall be based solely on marks obtained in Entrance Test, was issued on December 21 last year.
Tamil Nadu Additional Advocate General P Wilson said the notifications were issued without taking note of the objections raised by the state government.
He said the notifications contradicted 'Tamil Nadu Admission in Professional Educational Institutions Act' which abolished the Common Entrance Test for admission in professional courses.
He submitted that "it is interesting to note that the Union of India by and letter dated 03.1.2011 have declared that they have not as such approved the MCI notification. Hence in the absence of approval of the Central Government, the notifications are liable to be set aside".
