The Madras High Court today dismissed an application by an association of private schools seeking review of its October 5 order setting aside a single judge's order staying implementation of fee structure for unaided schools fixed by a government-appointed committee.
A division bench comprising Chief Justice M.Y. Eqbal and Justice T.S. Sivagnanam dismissed the review application of Federation of Association of Private Schools in Tamil Nadu.
The bench had passed the October 5 order while disposing a batch of appeals, including that by the state government, against the September 14 interim order of Justice K.B.K Vasuki on a batch of petitions by private unaided schools. Justice Vasuki had also directed the petitions "be posted before the appropriate Bench for expeditious final disposal".
The petitioners had challenged the "correctness, validity and enforceability" of the impugned May 7 order of the committee fixing the fees on the ground it was provisional in nature and violated the procedure laid down under the Tamil Nadu Act and Rules 2009. The federation, in its review petition, contended that the division bench order would render the pending writ petitions infructuous and foreclose main issues raised by them.
