Medical college in Puducherry allowed to admit students

The Madras High Court has stayed the operation of an order of the Board of Governors, constituted following the supersession of the Medical Council of India, of July refusing renewal of permission for admission of fourth batch of MBBS students for 2010-11 in the Sri Venkateswara Medical College Hospital and Research Centre, Ariyur, Puducherry.

Justice D.Hariparanthaman passed the interim order on a petition by the college. The institution prayed the court to call for the records relating to the order dated July 15 and quash the same as invalid and illegal.

It sought a consequent direction to the authorities to grant permission for renewal of admission of fourth batch of students during 2010-11. The judge directed the Union Health and Family Welfare department and the Board of Governors to provisionally permit the petitioner to admit students for this academic year.

However, the judge made it clear that admission of students was subject to the result of writ petition. The students should be notified about the pendency of the petition by the college.

The judge said candidates could choose the college during the counselling as was done in the previous years.

The council refused permission as two faculty members were present in the college when it made an inspection on June 14.

One of them was present in another college on June 18 and the other in yet another college on June 21.

Hence, the petitioner contravened the Establishment of Medical College Regulations and practised a systematic fraud, the order alleged. The judge held that the petitioner's action could not be termed fraud. Further, the petitioner need not have the full complement of 154 members of the teaching faculty.
