Direction from Supreme Court regarding MBBS seats

Tamil Nadu Government was directed to create additional seats in the I year MBBS for meritorious students by the 69 percent quota. It is decided to verify the constitutional validity and suitability of the law also. This is based on the claim of four students who went to the count that 50 percent ceiling as fixed by model commission is breached. The bench of Justices Dipak Misra and Gopala Gowda gave the order for the petitions of Minor R.Akshaya and three others who claimed the law prevented them from getting admission to MBBS though they are in 923,928, 932 and 854 ranks.

Senior counsel K.M.Vijayan appeal on behalf of the students. The bench extended its earlier order for the Academic year 2014-2015. To create additional seats in Medicine and other related Medical courses to take in meritorious candidates for the open category affected by the reservation policy.

The case is against the present policy. The petitioner’s claims that they came well within the cut off mark for 50% at the total seats available in government colleges including fresh additional seats for 2013-2014 and the government seat in private medical colleges. It they said, because of the policy they were not selected for the open category seats. They added the state created a constitutional injury to its citizens by exceeding the 50% ceiling on reservation and failed to identify the creamy layers belonging to BC- candidates.

It is clear, for more than 19 years additional seats were created for the FC’s with a continuous and periodic interim solution from the law (court), they demanded similar justice this year also.
