About Disability certificate for MBBS Admission

 The Madras High Court said that the Disability certificates issued by District Medical boards alone are not sufficient to get admission in MBBS course in disability question.

Four disabled candidates approached court claiming that they had been unfairly assessed and denied MBBS seat by selection committee.

Justice K.K. Sasidharan said that the government has reserved 3% of the total number of seats available in Govt Medical / Dental institutions four Orthopedically / Physically disabled candidates.  The Reservation is for a noble cause.  Seats under reservation quota should be given to eligible and deserving candidates.  The seats should not be given surely in account of the disability certificate provided by the District Medical board, since the fact is the subject experts were not point of the board.

T.Nalini, R. Anbumani, R. Devi Biya, and R. Sangeetha sought admissions under disability quota, saying they suffered from 40% to 70% disability.  They furnished relevant certificate from the District Medical board.  But at the time of cousnelling, they were put through a fresh Medical Examination by a committee, which concluded that all four suffered either less than 40% disability or more than 70% disability.  Based on this examination, they were denied seat.

The candidates argued that another round of Medical examination during counseling not necessary since they already had a disability certificate from the district board.

Special Govt pleader Krishna Kumar stated that the District boards did not have experts to assess all forms of disabilities. And added that examination by a fresher’s during counseling was a part of MCI rules  and guidelines.

Justice Sasidharan agreed with them and said, “Submission of disability certificate is a candidate’s precedent for entertaining application under the quota reserved for disabled candidates.  It is only when the candidates satisfy the selection committee by prima facie material that he / she is entitled to be considered under the reserved category. So it cannot be said that after having obtained a certificate from District Medical board it was not correct to send the candidates for second Medical examination by the expert team during counseling.

Justice warned the government saying its expert committee should compose senior professionals and the there should not be any room for complained.
