Madras HC dismisses PIL seeking taking over of a private medical college by government

Madras High Court dismissed a PIL seeking a direction to authorities to take over the management of a private medical college near here, alleging irregularities in running of the institution.

Petitioner R Kannan Govindarajulu contended that there are irregularities in the Adi Parasakthi college at Melmaruvathur in Kancheepuram district.

Citing media reports which said Medical Council of India ordered removal of 27 medical professionals from the Indian Medical Register and barred them from practice from three to five years, he said 25 of them were penalised for faking as full-time faculty.

He also alleged that those doctors were accused of giving false and misleading information on their working as faculty so as to get MCI approval to open courses in the college.

He said he had made a representation to the MCI on Nov 22, 2012, requesting it to take action against the college and alleged that the body has not taken any action yet.

He sought a direction to MCI to to withdraw recognition of MBBS course in the college permanently and transfer the students to other medical colleges in Tamil Nadu.

He also sought to direct the Health and Family Welfare Secretary to take over its administration and an interim injunction directing MCI not to include the college in the 2013-14 admission process for MBBS course.

A Division Bench comprising Justices R Banumathi and K Ravichandrabaabu said, "In our considered view, taking over the management of medical college is an extreme step for which the petitioner has not made out any substantial ground to entertain the writ petition."

Dismissing the PIL, the bench also said, "More so, the writ petition is under PIL.We do not see (any) public interest in the writ petition."
