Madurai bench of Madras HC dismisses petition against TET for graduate assistant post

The Madurai Bench of the Madras high court dismissed the plea, filed by seven Government aided schools seeking to quash the condition imposed by Education Department stipulating passing of Teachers Eligibility Test(TET) for appointment of Graduate Assistant.

Justice V Ramasubramanian dismissing the petitions filed by the schools including Hindu Middle school, Tirunelveli district, said the Government introduced the TET as per guidelines of the National Council for Teacher Education. Besides the Supreme court had said that the State government must take steps to provide Quality education through aided schools. Hence the Petitioners could not challenge the same.

Besides the State had viewed that adequate number of teachers' Training Insitutes and possessing graduate degree alone was not enough.The teachers coming out from there should be employable and eligible to be teachers.

Agreeing that it was true that the TET was held after the academic year started, the Judge said failure on the part of the government in conducting TET could not grant licence to flout rules.

The judge pointed out that the conduct of TET in Tamil Nadu and the percentage of pass had thoroughly exposed the quality of teacher education in the state.

There were lakhs and Lakhs of persons with degree in teacher education waiting on the rolls of the employment exchange. The pass percentage in the Tamilnadu TET exam was the poorest-at 0.34 per cent. In the Supplementary examination examination also only 2.9 per cent of the teachers passed out.

Quality education had now become sine quo non for the exercise of the fundamental right to education, the judge said and refused to quash the condition.
