Madurai Bench of the Madras high court on Monday ordered notice to Tamil Nadu Higher Education principal secretary among others on a PIL seeking to quash a notification issued by the Bharathidasan University to fill 38 posts in various teaching categories.
Justices M.Jeyachandran and D.Raja posted the case for hearing to November 26 after ordering issue of notice.
Petitioner Dr.Vasanthi Natchiappan, president of the Bharathidasan University Teachers Association (BUTA), submitted that out of 38 posts, 13 had been allotted to Scheduled Caste Arunthathiar community,though as per rule only one post should be reserved for SC(A).
"This is against the spcial reservation of 3 per cent for SC(A). It has been done with the intention that If SC(A) candidates were not available to all those categories of posts,then the posts could be given to People of their choice," she said.
The notification,without determining the actual number of vacancies and without allotting the same as per the reservation policy was liable to be quashed.
As the posts were being filled through direct recruitment, existing teaching staff would not get promotion under Career advancement scheme of the University Grants Commission, the petitioner contended.
