Madras High Court set aside earlier orders passed by Private School Fee Determination Committee (PSFDC) and directed it to re-consider the matters of petitioner schools afresh in the light of the new guidelines framed by the court.
A Division Bench, comprising Justices R Banumathi and K K Sasidharan, said the writ petitions were remitted back to the committee for consideraton of the matters afresh in the light of the guidelines in the court's order on May 3, 2012.
Petitioners Chinmaya Vidhyalaya, Chennai, Isha Vidhya Matriculation School, Villupuram, Isha Vidhya Matriculation School, Erode and Sri Ramakrishna Matriculation Higher Secondary School, Tiruvannamalai challenged the order passed by Private School Fee Determination Committee and contended that it was not in conformity with Tamil Nadu Schools (Regulation of Collection of Fee) Act, 2009 (Tamil Nadu Act 22 of 2009).
These schools also prayed to direct concerned authority to direct the committee to permit them to collect the fees as proposed by them for academic years 2010-11, 2011-12 and 2012-13.
Justice S R Singharavelu of the committee had passed impugned orders fixing the free structure for three academic years 2010-11, 2011-12 and 2012-13.
The petitioners contended that the committee did not take into account the total expenditure as per the audited incurred by the schools and the proposed fee structure was not in commensurate with the actual expenditure incurred by them.
They prayed the court that the orders of the Committee be set aside and the matters be remitted back to the committee to reconsider the matters afresh in the light of the guidelines issued by the court on May 3, 2012.
The Madras High Court had on May 3 last set aside orders of a Tamil Nadu Government appointed School Fee Determination Committee and remitted the matter back to the Justice K Raviraja Pandian committee for fresh consideration.
