Justice G S Sistani of Delhi High Court issued notices to the Health Ministry and the NBE to respond to a plea, which alleged the examinations for diploma and post diploma courses in pathology have not been held since January last year and asked them to file responses in two weeks and fixed the matter for hearing on November 11.
The court was hearing the petition of Shilpa Agarwal, a doctor, who alleged the NBE was not holding examinations for post-diploma Common Entrance Tests and Diploma of National Board (DNB) Secondary course in Pathology since January 2011 and this was "arbitrary and illegal".
Lawyers Mayank Jain and Parmatma Singh, appearing for the doctor, sought a direction to NBE to conduct the tests.
NBE, a statutory body, has been established to conduct post-graduate medical examinations across the country to maintain uniformity.
NBE also conducts DNB in different specialities like Pathology and the DNB is considered to be equivalent to Doctor of Medicine (MD).
The DNB degree gives doctors the requisite qualifications to become eligible for teaching posts in the concerned specialities.
"In a scenario, where there are very limited seats for MD, the medical professionals (MBBS) choose to opt for such courses so as to contribute to medical research in the country. However, due to policy paralysis and executive inaction on the part of NBE, the examination for DNB pathology has not been conducted for last one and half year...," the petitioner said.
