Chennai: Madras HC has upheld a TN govt order restricting applications for Diploma in nursing courses for the academic year 2008-09 only to female candidates.
Dismissing a petition filed by Ashad Ali challenging the order, Justice K Suguna held that the decision of authorities concerned in restricting admission to female candidates alone for admission to the course 'has to be accepted.
Stating that there was no dispute about the fact that there were already sufficient male nurses available, the Judge said 'nursing services must meet the health needs of society most effectively and for that whatever is essential has to be implemented'.
The Judge said if services of male nurses was not needed from the health point of view of the public and the welfare point of view of the society then the restriction had to be accepted.
'Since the issue in question does not relate to reservation, the judgments relied upon by counsel for the petitioner will not be of any help to the petitioner', the Judge said and dismissed the petition.
According to the petitioner, who had passed the plus two exam held in March 2008 and wanted to obtain a diploma in nursing, the decision restricting applications only to women violated the Constitution.
The petitioner seeking to quash the government's order of November 27 last contended that ratio of admission before the order was 1:9 male and female candidates.
