Orissa High Court has refused to interfere in the administrative affair of Diocese-run Stewart Science College of Cuttack and declined to grant 'stay' on the appointment of a Principal selected by the College management.
The Division Bench comprising Justice L Mohapatra and Justice B K Patel adjudicating over the writ filed by S K Saha, a senior teacher of the college, refused to interfere in the internal decision of College management as it enjoys the power to select its Principal under Article 30 of the Constitution.
Even the State government in its opinion before the Court recognized the rights of the minority Community over the administrative functioning as enshrined under the provisions of the constitution.
Saha in his petition had urged the court to stay the appointment of Debashis Pradhan as Principal as he was the senior most teacher of the college.
Pradhan was selected as the new principal by the college authorities.
