HC stays appointment of VC of IMU

The Madras High Court stayed the appointment of Capt M Baweja as Vice Chancellor of Indian Maritime University (IMU), Chennai, till January 11.
 
Giving interim injunction on two writ petitions filed by Dr P Vijayan, Justice K B K Vasuki accepted the argument of the petitioner that the President was the competent authority to appoint the Vice Chancellor (VC) of IMU and not the Union Ministry of Shipping, Road Transport and Highways, which had passed the impugned order.
 
The Ministry in its November 18 last order had appointed Baweja as the VC of the university from November 19 in addition to his existing duties on completion of the tenure of the petitioner as VC of the IMU.
 
Vijayan had challenged the order mainly on the ground that under 'The Indian Maritime Act (2008)', the President, who was also a "Visitor" of the university, was the competent authority to appoint the Pro-Vice Chancellor and any other person to hold additional charge of VC and none else.
 
The petitioner also drew the attention of the court to relevant provisions of the Act under which the VC, appointed by the Visitor, 'shall hold office for a term of three years and his term can be extended by further years at the discretion of the Visitor and as and when the office of the Vice Chancellor becomes vacant.
 
The petitioner sought to quash the impugned order and consequently a direction from the court to the ministry to permit him to function as VC.
