The Madras High Court has directed authorities to issue appointment letters within six weeks to candidates, selected by the Tamil Nadu Public Service Commission on October seven last, for various Group-II posts.
Justice K Suguna issued the directions on a batch of petitions filed by about 1600 candidates, who had emerged successful and had also been issued with allotment orders but were yet to be given appointment orders.
The TNPSC in a counter affidavit claimed that the results had been approved on October 7 itself but it was the duty and responsibility of the Commission's Secretary to complete all the other processes. As the appointment orders had to be prepared manually, it was bound to take a while to issue inpidual orders, the affidavit said.
The petitioner's counsel, senior advocate KM Vijayan, submitted that it is natural for successful candidates to get anxious, if they are not issued the appointment orders even after selection.
However, moments after the delivery of the judgment, a mention was made before the judge by an advocate, that the direction should not have been given, as the connected matters were being before the first bench headed by the Chief Justice.
Vijayan clarified that the batch of petitions pending before the First Bench related to the legality of bringing the TNPSC under the ambit of Directorate of Vigilance and Anti-Corruption. He said there was no interim order on the matter seeking cancellation of all appointments made by TNPSC.
Hence there was no impediment in disposing of the present batch of petitions by candidates, who sought their appointment orders to which they were entitled.
Acceding to his plea, the judge reiterated her order, and directed the authorities concerned to issue appointment orders to eligible candidates within six weeks.
