Nurses' degrees; Govt to examine issue of framing rules: SC

Updated on: Saturday, December 10, 2011

The Supreme Court asked the Centre to look into the issue of framing some guidelines for private hospitals to prevent them from retaining the original certificates of staff nurses at the time of their employment.

A bench headed by Chief Justice S H Kapadia, who at the beginning was not inclined to entertain a PIL filed by Indian Professional

Nurses' Association, asked the Additional Solicitor General Mohan Prasaran to look into the issue.

Senior Advocate Colin Gonsalves, appearing for the association, pleaded that the court should pass some direction to prevent private hospitals from retaining the original certificate.

Referring to a Delhi High Court order directing the city government to frame guidelines in this regard, he submitted that similar order is required from the Supreme Court as such practise is prevalent all over the country.

The High Court had on July 20 directed the government to frame the guidelines within three months.

"We direct the city government to consider framing of guidelines in three months so that the nurses don't feel that they are being bonded and harassed," the High Court had said.

The court had passed the order on a PIL filed by a nurse, who hails from Kerala, alleging the Indraprastha Apollo Hospital refused to give back her original certificates and accept her resignation as she has to attend her terminally ill mother in hospital.
