HC notice to UGC, Guj univs over implementation of reservation

The Gujarat High Court issued notices to the UGC, the state government and all the grant-in-aid universities of the state on a petition demanding proper implementation of government reservation policy in such educational institutes.
 
A pision bench of acting Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala asked the respondents UGC, state government and all the 13 universities of the state to file their replies by December 28.
 
The petition has been filed by Arjun Rathva and Bharat Gamit, president and vice-president respectively of the Akhil Gujarat College and University Apasi Teachers Association, Surendranagar district.
 
They have sought directions from the court to the universities of Gujarat to comply with the guidelines of the UGC issued on December 6, 2005 for strict implementation of reservation policy of the government in universities, colleges, and other grant-in-aid institutions and centres.
 
They have further sought that the universities be also directed to make necessary amendments in their existing acts/ rules/statues in the interest of justice.
 
The petitioners have alleged that varsities of the state were not complying with the UGC guidelines for strict implementation of reservation policy for adequate representation in the executive body/ syndicates/ senate thereby depriving members of the Scheduled Tribes and Scheduled Castes their constitutional rights.
 
They have further stated in their petition that despite several oral and written representations to the universities as well as the UGC for the compliance of the reservation guideline, no action has been taken till date.
  
"This action on the part of respondents (universities) is arbitrary and violative of Article 14, 16, 19 and 21 of the Constitution of India as well as violation of the principle of law and equality and personal liberty of petitioners," the petition said.
