Maha govt order mandating NOC for non-SSC board schools stayed

The Bombay High Court stayed a government resolution, which makes it mandatory for the schools, affiliated to boards, other than the state board (SSC), to get a no-objection certificate from the Maharashtra government.
 
The Unaided Schools Forum and others have filed a petition in the High Court against the government resolution (GR) that was issued in August 2009.
 
"The GR lays down the procedure/conditions for the NOC. The bench of Justices B H Marlapalle and Nishita Mhatre has stayed it, but it has also said that the government can get appropriate law passed on this issue," government lawyer Nitin Deshpande said.
 
The petitioners, who represent schools, affiliated to non-SSC boards, like CBSE, ICSE, IB, etc, contend that they do not fall in the jurisdiction of the state government, as these boards are autonomous and are not set up by the Maharashtra government.
 
Also, in the light of provisions of the Right to Education Act, the GR has become irrelevant, they argued.
 
The NOC pre-conditions state that schools must teach the mother-tongue, should have three-language curriculum up to VIIth standard. They also say that school fees must be approved by the state committee.
 
It also requires that such schools submit themselves to audit and inspection by the state authorities, among other parameters.
