The Delhi High Court on Wednesday refused to stay the announcement of the results of the All-India Engineering Entrance Examination (AIEEE) held on May 1 and then on May 11.
However, the Court has made the results subject to a decision on the bevy of petitions challenging the holding of the examinations on a rescheduled time and date.
A Division Bench of Justices Dipak Misra and Sanjiv Khanna issued a notice to the National Law University seeking its response on the legal aspect of some of the candidates not being able to appear for the examination as a result of the rescheduling.
The examination was rescheduled to be held at 1 p.m. on May 1 following the leak of the question paper. For the benefit of those candidates that could not appear in the rescheduled examination owing to there having been a clash of timings between the AIEEE and the Armed Forces Medical College examination, the test was conducted again on May 11.
The Court had earlier dismissed a plea asking that all candidates be allowed to appear in the rescheduled examination on May 11.
The petitioner had submitted that the candidates were made to appear in the rescheduled examination on May 1 without any prior intimation, and some were not given the option of appearing in the rescheduled examination on May 11 — as had been given to those candidates whose examinations clashed with the AFMC.
The petitioners had argued that they had appeared in the re-timed examination in adverse conditions — they were asked to vacate the examination centres abruptly without being given any explanation and made to wait out in the scorching sun for about three hours before being told that they had to take the examination at 1 p.m.
