The Patna High Court upheld the order of a single bench setting aside the appointment of the vice-chancellors of Magadh University and Veer Kunwar Singh University.

A pision bench comprising justices Shiva Kirti Singh and Shivaji Pandey upheld the order of Justice Ajay Kumar Tripathy who had on May 4, 2011 quashed their appointment.

The appointment was quashed on a writ petition filed by VKSU professor Pramod Kumar Singh and others seeking the court's intervention for appointment of scholars for the post.

The petitioners had alleged that Arvind Kumar and S K Sinha were appointed as vice-chancellors of MU and VKSU respectively without considering the state government's recommendations or holding consultations with it, violating the Bihar Universities Act 1976.

Justice Tripathy had set aside the appointment of the vice-chancellors since there was sufficient material to demonstrate that no consultation took place between the state government and Chancellor before the notification was issued from Raj Bhavan.
