HC issues notice to pvt school on woman's plea for certificate

The Delhi High Court sought response from city government and a private school on a plea of a poor widow, who is being denied mark sheet and other certificates of her son because of non-payment of fees.

Justice Kailash Gambhir issued notice to Delhi Government and Guru Harkishan Public School and directed them to file their response within two weeks and listed the matter for further hearing on September 5.

Rekha, in her petition, pleaded before the court that the school be directed to release mark sheet and transfer certificate so that she could get her son admitted to a government school as it was difficult for her to pay the tuition fee after the death of her husband.

She submitted that arrears of Rs 52,000, which accumulated due to non-payment of school fee due to financial hardship, should be waived.

Rekha said she had requested the school time and again for grant of full concession to her son studying in class seven as she is a poor widow unable to bear the burden of fees but her plea was turned down.

"She has not been in a position to afford the school fees at all and has been requesting the school to grant full fee concession to her son Abhishek till he completes Class XII. She had been running from pillar to post for grant of full fee concession to her son but did not succeed," she said in her petition filed through her counsel Ashok Agarwal.

Rekha also said that she is not in a position to pay school fees as her husband died in 2008 and she casually gets work of stitching clothes and earns Rs 3,000 a month.

She submitted that the act of the school was in violation of her son's fundamental right to education.
