HC nod to MCI inspection for renewal of permission

Modifying its January 9 order, the Madras High Court today permitted the Medical Council of India (MCI) to proceed with inspection of medical colleges for
renewal of permission.
Justice P Jyothimani in his order said the council should not pass orders till March 7.

On January 9, the Court had restrained MCI from conducting inspection following a petition by Federation of Association of Unaided Professional Educational Institutions in India.

The federation had sought a direction to MCI and health Ministry to consider their representations dated Jan 17 and 24 and pass appropriate orders.Until it was done, MCI should keep in abeyance inspection of medical colleges for this academic year.

The petitioners also contended that the MCI rules impeded smooth functioning of medical colleges in the country. Several medical colleges were being denied permission or renewal of permission on the ground of failure to comply with the
mandate, they said.

When the matter came up today, Counsel for MCI submitted that MCI could not inspect medical colleges for renewal of permission due to the court order.

Justice Jyothimani then modified the earlier order and posted the matter for further hearing on March 7th.

He also directed the petitioner to produce the list of members of the petitioner association to enable the court pass further orders.

The judge made it clear that in case any institution gave a letter to MCI, stating they are not members of the petitioner association, it was open to the council to pass orders in respect of those institutions.
