Regional Committees have power to inspect institutions: HC

Expressing concern over mushrooming of educational institutions in the country without complying with the norms under NCTE Act, the Delhi HC said the Regional Committee is empowered to inspect and also withdraw the recognition of a college.

The court dismissed a batch of petitions filed by some colleges imparting teachers education in various places, saying the council only has the power to inspect a college and the RC has no power to inspect once the college was granted
recognition under the Act.
   
"I am of the opinion that it (RC) is the body vested with the power to grant and withdraw the recognition which is best suited to carry out the inspection necessary for ensuring the continued compliance of laws, rules, regulations, norms and standards by the institutions granted recognition," said Justice Rajiv Sahai Endlaw.
   
"The regulatory power vested in the Regional Committee would be severely affected without such power to inspect. A regulatory body cannot be blindfold," Justice Endlaw added.
    
He also said while travelling across the country by road, one can notice a large number of buildings along the highways proclaiming themselves to be educational institutions and with no settlements in vicinity.
   
"One often wonders as to who studies in such colleges. Cases are also not unknown and have come before this court where the allegations are that the infrastructure shown to the visiting team prior to the grant of recognition was found to be no longer existing," the court said.
