Tamil Nadu Motor Vehicles (Regulation and Control of School Buses) Special Rules 2012 challenged under various provisions

Madras High Court ordered issue of notice to Tamil Nadu government on a petition challenging various provisions prescribed in the Tamil Nadu Motor Vehicles (Regulation and Control of School Buses) Special Rules 2012.

A Division Bench, comprising Justices Chitra Venkataraman and R Karuppiah, ordered notice to the government, returnable by December 12.
   
K R Nandhakumar, General Secretary of Tamil Nadu Nursery, Primary, Matriculation and Higher Secondary Schools Association, in his petition contended that various provisions of the rules are inconsistent with and contrary to provisions contained in the Motor Vehicles Act and Cenrtral Motor Vehicles Rules.
   
He said provisions of the impugned rules insist on compliance of structural modifications by Nov 1 2012,while the rules themselves have been notified only on Sep 30, 2012. "It will not be possible to carry out such changes at such short notice. Any any rate, the rules are bad," he said.
   
He further prayed that the court declare certain impugned rules in the Tamil Nadu Motor Vehicles (Regulation and Control of School Buses) Special Rules 2012 as arbitrary, illegal and unconstitutional and ultra vires the provisions of Motor Vehicles Act, 1988.
