Madras HC rules appointment of Puduchery Registrarar as illegal

The Madras High Court on Thursday set aside the appointment of S. Loganathan as the Registrar of Pondicherry University.

Holding the appointment illegal, Justice N. Kirubakaran directed the Vice-Chancellor to issue a fresh notification inviting applications from prospective candidates and complete the selection process within two months.

The Judge was allowing a writ petition by P. Kasirajan, who challenged the appointment.

He sought to quash the May 6 orders and the proceedings dated June 17, 2010 relating to the appointment.

The petitioner stated that he was the most senior eligible candidate to be considered for the post.

The post should be filled only through direct recruitment. Mr. Loganathan had been appointed on deputation basis.

Mr. Justice Kirubakaran said that the university, for reasons best known to it, renewed Mr. Loganathan’s tenure for five years or till superannuation, which was contrary to law.

He had no qualification for appointment as Registrar in 2004 itself.

There was no advertisement for appointment by deputation and the advertisement in September 2004 invited applications only for direct recruitment.
