University plan for PG Diploma in Medical sciences illegal: HC

The Madras High Court has held as illegal a proposal by Dr M G R Medical University to introduce 11 PG diploma courses in medical sciences in the academic year 2011-12.

Allowing a batch of petitions by M Ramesh and 24 others, Justice N Paul Vasanthakumar held that the university was not empowered to grant permission to any institution or medical college to conduct any PG diploma course in medical sciences without the previous approval of the Central government, as
required under the Medical Council of India Act.
 
As submitted by senior advocate K M Vijayan, representing the petitioners, all PG diploma courses now permitted by the university are available in MCI rules either as PG diploma courses or part of the degree courses or both, he said, adding it was thus evident that the university was seeking to introduce the course in different names on the same subject.
 
The petitioners said the university proposed to introduce 11 PG diploma courses in medical sciences without the Centre's or MCI's approval. These courses, including HIV medicine, (1/2 years) were part of the existing recognised courses approved by MCI, being conducted through different colleges and examinations were conducted by the university.
 
The university had carved out the syllabus framed by MCI and intended to introduce new courses without necessary approval, they alleged.
